DYING DECLARATION :— Creditworthiness of dying declaration depends on proof of state of fitness of maker of statement which has to be proved objectively — Judgment of fitness of person making statement has to be by person before whom such statement is made and it is an opinion based on rationale on the basis of which it is formed.
